Attorney Lisa Blitstein Presents on Environment & Energy Law Updates at 2024 MSBA Legal Summit

On June 5, MM&C Associate Lisa Blitstein presented on Recent Developments in Environmental and Energy Law at the 2024 MSBA Legal Summit in Ocean City, Maryland. Blitstein joined the outgoing and incoming Chairs of the MSBA Environment & Energy Section, respectively, Stephen Luttrell of Baker Donelson, and Kurt Karsten of Karsten Law, for an engaging panel discussion.

Attendees were briefed on developments in environmental and energy policies impacting Maryland practitioners and their clients. Topics included changes to Maryland statutes, regulations, and case law. Legislative updates included Maryland’s 2024 legislative session focusing on climate change, regulation of hazardous materials, and renewable energy. Proposed and recently-enacted regulations from the Maryland Department of Environmental and Maryland Public Service Commission were also addressed.

Blitstein specifically covered the Clean Water Justice Act of 2024, an update to environmental standing law in Maryland.  The Act, effective October 1, 2024, will allow Marylanders to bring citizen suits for certain violations of state laws concerning wetland pollution. This comes in response to the U.S. Supreme Court’s decision in Sackett v. EPA, which eliminated the ability to bring such citizen suits under the federal Clean Water Act.
