Estates & Trusts
The delivery of expert estate and business succession planning and trust and estate administration has long been a major part of the firm’s practice. Each attorney in this practice area, in addition to having well-rounded, broad knowledge of these disciplines, has developed a particular expertise in discrete areas of the law in order to meet the need for increasingly sophisticated business and personal planning in a complex legal environment.
Estate Taxation
The firm assists clients in all aspects of estate related taxation, including federal and state estate taxes, gift taxes and generation-skipping transfer taxes. We counsel clients on complex issues surrounding business succession, including corporate restructurings, gifting of interests, creation of trusts, buy-sell agreements, and the like.
Estate Planning
In the area of estate planning, Miller, Miller & Canby’s attorneys assist clients in developing an effective plan for the orderly, cost-efficient transfer of wealth, while balancing the plan with the appropriate estate and gift tax planning.
Such planning often involves financial, insurance and business succession planning. Expertise is available in how to retitle property interests, make lifetime gifts, and properly fund trusts created by the client to take effect immediately or at death. The firm’s attorneys draft the appropriate documents to carry out the plan, such as trust agreements, wills, deeds, and buy-sell agreements. Miller, Miller & Canby’s attorneys are also exceptionally skilled at offering tax advice, preparing tax returns (gift and generation skipping tax returns) and tending to the ancillary administrative details.
Estate Administration
Miller, Miller & Canby has particular skill in assisting clients and their families with legal needs arising at death, including probating wills and administering decedent’s estates, administering trusts taking effect at death, winding up affairs of trusts upon their termination, transferring assets, preparing tax returns, and handling estate and gift tax audits by the IRS.
Planning
A significant part of Miller, Miller & Canby’s service involves advising clients with respect to lifetime business matters. These include planning for the management of property interests at such time as the owner no longer wishes, or is able, to handle his or her own affairs. Planning for lifetime management of affairs also addresses health care decision-making. In this area, we discuss advance directives such as living will declarations and health care powers of attorney.
